Decision on imposition of measures to eliminate shortcomings

By decision, municipality imposes measures to eliminate shortcomings that can cause fire or make person and property rescue difficult and also controls fulfilling of these measures. Municipality also decides issue preclusion from usage. (1)

Through the control groups of municipality performing preventive fire controls, municipality reminds natural person and appropriate personnel of found deficiencies, requests to remove these failures without undue delay, supplies necessary information and explanation in order to perform this. Deficiencies that can not be rectified without undue delay, control groups of municipality notify to the municipality that by decision imposes terms to eliminate the shortcomings. (2).

In order to prevent a fire, legal person and natural person – entrepreneur are obligated to fulfil measures to eliminate the shortcomings imposed by an organ performing state fire control or by the municipality, by the deadline determined by them.(3)

District Directorate imposes a fine on a legal person or a natural person – entrepreneur up to 8 299 EUR (250 000 SK) for breach of duty provided by this Act in such way that he fails decision on the issue preclusion from usage or on breakdown; he fails duties resulting for him from measures imposed by an organ performing state fire control or by the municipality

The fine can be set within one year after the date when body that carries out state fire control has learned of breach of duty, within three years at latest after the date when breach of duty has occurred. (5)
